Can I truthfully state that I have
not been arrested/convicted after
an expungement?
Yes, for most jobs or licensing, you can truthfully
answer that you have never been arrested/convicted once your expungement is complete, except
for in a few limited circumstances, which you can
call our firm to discuss for a no obligation, no charge free consultation. The exact wording from the Order
that the Judge signs to officially grant your
expungement states that “the matter(s) which are
the subject of this Order shall be deemed not to
have occurred and the Petitioner may answer accordingly any questions relating to their occurrence."
How long does the expungement
process usually take?
From beginning to end, the process usually takes
about 3 months until completed and you can
truthfully state you have never been arrested or
convicted. It can take an additional few weeks until
we receive confirmation from the New Jersey State
Police that they have cleared their computer records
and sent to the FBI to request they do the same. In
some cases, however, particularly where there are
numerous matters, very old cases, and/or opposition to your Petition by a law enforcement agency,
the process can be delayed.
Will I have to appear in court or
otherwise be present? What if I live
out of state?
The New Jersey expungement process is designed
to not require appearance for the efficiency of all
parties, the Court, etc. If your case involved a
matter not clearly eligible for epungement, heinous facts, or if a Judge decided to require an
appearance, however, it could happen, but would
be very out of the ordinary. We have handled
cases for clients in other states and even other
countries who have had New Jersey records.
Neither the location of the client, nor where in
New Jersey the matter happened is an impediment in anyway to our effectively and efficiently
handling your case.
If the charges were dismissed, or I
was found not guilty, will the arrest(s)
still show on my criminal record?
Yes, until you have the record expunged. Arrests
are never automatically expunged from your record
no matter how much time passes or even when the
charges were dismissed (even if through PTI/
Conditional Discharge) or you were acquitted at
trial.
